Terms of Service
These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “user”) and Bloom Space (“Bloom”, “we”, “us”, “our”) governing your access to and use of the Bloom Space mobile application, website at bloomspace.app and any related services (collectively, the “Service”). By creating an account or using the Service you accept these Terms in full. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to create an account. We do not knowingly collect personal information from children under 13; if we become aware that we have, we will delete the account and any associated data. Some regions may require a higher minimum age, and we comply with those local requirements where applicable.
Accounts identified as belonging to users under 18 years of age are placed under additional safeguards by default: their inbound message-request inbox is restricted to people who share a sanctuary with them, and they are not eligible to complete in-app purchases. We may request age verification at any time and suspend or delete accounts where age cannot be reasonably established.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials.
- You must provide accurate information and keep it up to date.
- You must not impersonate another person, sell or transfer your account.
- You may create up to four (4) personas per account; each persona is bound by these Terms.
- We may refuse, suspend or terminate accounts that violate these Terms or applicable law.
3. The Service
Bloom is a small social sanctuary built around personas, private spaces, voice rooms, stories and clips. Features may be added, modified, limited or removed at any time. Some features are invite-only or available only on certain platforms (iOS / Android). We do not guarantee that the Service will be uninterrupted, error-free, or available in every region.
4. User Content
“User Content” means any text, image, audio, video, voice recording, message, profile information or other material you upload, post, transmit or share through the Service.
4.1 Ownership
You retain all ownership rights in your User Content. Bloom does not claim ownership of anything you create.
4.2 Licence you grant to Bloom
Solely to operate, provide, secure and improve the Service, you grant Bloom a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, transcode, modify (for technical reasons such as resizing or format conversion), distribute and display your User Content within the Service. This licence ends when you delete the relevant content, except where retention is required by law, for back-ups, safety review, or where the content has been shared by others.
4.3 Licence you grant to other users
When you post User Content into a sanctuary, persona feed or shared space, you grant members of that space a limited licence to view, react to and (where the feature allows) re-share that content within the Service.
4.4 Your responsibilities
You promise that, for any content you upload, you either own it or have permission to use it, and that it does not infringe anyone's rights.
5. Acceptable Use
You agree not to use the Service to:
- Post content that is illegal, sexually exploitative of minors, terror-related, or that incites violence or hatred against a protected group;
- Harass, bully, threaten, dox, stalk or impersonate any person;
- Share another person's private images, voice or personal information without consent;
- Upload malware, scrape the Service, reverse engineer it, or interfere with its security;
- Use automated tools, bots, or fake accounts to inflate engagement;
- Sell, rent, advertise or solicit on the Service without our written permission;
- Circumvent moderation, age-gates, rate-limits, or safety controls.
6. Personas, Identity & Privacy
Personas allow you to express different sides of yourself in different sanctuaries. You are still the same legal person behind every persona, and these Terms apply to all of them. We may, in extreme cases (e.g. credible threats, court order), associate persona activity with the underlying account for safety or legal reasons; otherwise we do not publicly link your personas.
7. Purchases & Subscriptions
Some Service features may be offered as one-time purchases or auto-renewing subscriptions. Prices are shown in your local currency where possible. Purchases made through the Apple App Store or Google Play are billed by the platform and governed by their respective terms; refunds for those purchases must be requested through the platform. Auto-renewing subscriptions renew at the end of each period unless you cancel at least 24 hours before the renewal date.
8. Termination
You may delete your account at any time from Settings → Account → Delete account. We may suspend or terminate your account immediately, without notice, for serious or repeated violations of these Terms, for activity that endangers other users, or where required by law. On termination, your User Content will be deleted in accordance with our Privacy Policy and applicable retention obligations.
9. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Bloom disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. Bloom is not a medical, mental-health, or therapy service; nothing in the Service is medical advice.
10. Limitation of Liability
To the maximum extent permitted by law, in no event will Bloom, its affiliates, officers, employees or agents be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of your use of the Service. Our total aggregate liability for any claim arising from these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) US $100. Some jurisdictions do not allow these limits, in which case they apply only to the maximum extent permitted.
11. Indemnity
You agree to indemnify and hold Bloom harmless from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your breach of these Terms.
12. Changes to the Terms
We may update these Terms from time to time. If changes are material we will notify you in-app or by email at least 14 days before they take effect. Continued use of the Service after the effective date means you accept the updated Terms.
13. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction where Bloom is incorporated, without regard to its conflict-of-laws rules. Subject to mandatory consumer-protection laws of your country of residence, any dispute will be resolved in the courts of that jurisdiction. Where required by your local law you retain the right to bring a claim in your local courts.
